Terms of service

These Terms of Service (hereinafter referred to as "the Terms") set forth the conditions for using the services (hereinafter referred to as "the Service") provided by OMOMUKI (hereinafter referred to as "the Store") on this website. All registered and guest users (hereinafter collectively referred to as "Users") must use the Service in accordance with these Terms.

Article 1 (Applicability)

  • These Terms apply to all relationships between the User and the Store regarding the use of the Service.
  • In addition to these Terms, the Store has established various individual regulations, such as the Shipping Policy, Refund Policy, Privacy Policy, and Legal Notice (hereinafter collectively referred to as "Individual Provisions"). These Individual Provisions constitute part of these Terms.
  • If any provision of these Terms conflicts with the Individual Provisions, the Individual Provisions shall take precedence.

Article 2 (Registration)

  • Registration is completed when an applicant agrees to these Terms and the Store approves the application.
  • The Store may decline an application if the applicant provided false info, has previously violated these Terms, or if deemed inappropriate.

Article 3 (Login ID and Password Management)

  • Users are responsible for strictly managing their login ID and password.
  • Users may not transfer or share their ID/password with any third party.

Article 4 (Purchase Agreement)

  • A sales contract is established when the Store sends a notification accepting a User's purchase application.
  • The Store may cancel the contract without prior notice if a violation of these Terms is discovered.

Article 5 (Payment Deadlines and Cancellations)

  • For post-payment methods (Convenience Store, etc.), if payment is not confirmed within 5 days, the order will be automatically cancelled.
  • Upon cancellation, the Store reserves the right to immediately resume sales of the item to other customers.

Article 6 (Delivery and Inventory)

  • Items are typically shipped within 5 business days after payment confirmation.
  • Shipping may be delayed due to events, long-term absences, or force majeure.
  • Inventory is shared with offline events. In case of a sell-out due to update timing, the order will be cancelled and refunded.

Article 7 (Risk of Loss and Delivery Troubles)

  • Title and risk of loss transfer to the User upon delivery to the carrier.
  • The Store is not liable for carrier delays, loss, or non-delivery at accommodations (hotels).

Article 8 (Intellectual Property)

  • All content on the Service belongs to the Store or respective right holders. Unauthorized secondary use is prohibited.

Article 9 (Personal Use and Prohibition of Resale)

  • The Service is for individual consumers and authorized partners.
  • Reselling products for profit without prior consent is strictly prohibited.
  • The Store assumes no responsibility for products resold in violation of this article.

Article 10 (Prohibited Actions)

  • Violation of laws, criminal acts, infringement of rights, or interference with the Store's servers.

Article 11 (Suspension of Service)

  • The Store may suspend the Service without notice for maintenance or due to force majeure.

Article 12 (Usage Restrictions and Deregistration)

  • The Store may restrict usage or delete a registration without notice if a User violates these Terms.

Article 13 (Withdrawal)

  • Users may withdraw from the Service through the prescribed procedure.

Article 14 (Disclaimer of Warranties and Liability)

  • The Store is exempt from liability regarding inherent characteristics of upcycled materials.
  • Users are responsible for all customs duties and taxes for international shipments.

Article 15 (Returns and Refunds)

  • No returns for customer convenience. Refunds are issued only for Store errors as per the Refund Policy.

Article 16 (Changes to Service)

  • The Store may change or discontinue the Service without prior notice.

Article 17 (Changes to Terms)

  • The Store may change these Terms at any time without notice.

Article 18 (Handling of Personal Information)

  • Handling shall be in accordance with the Privacy Policy.

Article 19 (Exclusion of Anti-Social Forces)

  • Users warrant they are not part of anti-social forces. The Store may cancel any contract if this is violated.

Article 20 (Prohibition of Transfer of Rights)

  • Users may not transfer their rights or obligations under these Terms to a third party.

Article 21 (Governing Law and Jurisdiction)

  • Governed by the laws of Japan. Exclusive jurisdiction: Sapporo District Court.
